Halle Berry is fighting bitterly with her ex Olivier Martinez for sole custody of her 10-year-old son Maceo
Regarding the terms of their existing child custody agreement, Halle Berry is bringing her ex-husband Olivier Martinez back to court.
The 58-year-old Catwoman actress filed paperwork to request exclusive custody of their 10-year-old son Maceo’s medical and educational choices.
According to documents viewed by TMZ, the Oscar winner and her attorneys claim Martinez, 58, refuses to address the boy’s behavioral and learning issues in their case. Due to the Unfaithful actor’s ‘turbulent behavior’ and his preference for their son to learn soccer over academics, Berry alleges Maceo has lagged behind his peers.
Additionally, she said Martinez turned down his son’s tutoring because it would conflict with soccer practice. The Moonfall actress further alleges that her ex is putting his own spin on the arguments between Maceo’s parents and that he returns from extended periods of time with his father hostile and irrational.
In the end, she is hoping the judge will give her the «ability to make decisions related to therapy and education.» On the South African set of the movie Dark Tide in 2010, the ex-couple got together. The actress and her 16-year-old daughter Nahla were going through a difficult separation at the time with her previous partner Gabriel Aubrey.
After getting married in 2013 and having Maceo in 2014, they declared their separation after just two years of marriage. Custody of their kid was the primary point of contention during the divorce, which was ultimately resolved in 2023. According to court documents, Martinez would get 4.3 percent of the actress’s earnings over $2 million in addition to $8,000 in child support each month.
In addition, she would pay Maceo’s whole medical bill, health insurance, tuition, and extracurricular fees. Their son would attend family and individual therapy, according to the agreement as well.
This comes after Berry’s attempt earlier this month to make Martinez attend co-parenting therapy in order to settle disagreements with their son was unsuccessful.
In an attempt to «take the summer off,» Berry had claimed Martinez was attempting to postpone their agreed-upon co-parenting therapy. However, a judge rejected the actress’ request, finding a «lack of exigent circumstance,» according to court records acquired by Radar Online.
The couple decided to go to therapy in May in order to «resolve disputes and conflicts between them in an effort to successfully co-parent» their son. However, according to court records that TMZ was able to obtain, Berry’s ex decided to push back the sessions until September in order to give him time off for the summer without first consulting her or their therapist.
She states that he missed the July sessions in order to travel to his home country of France, and that he wants to postpone the August sessions because his brother would be in town.The actress requested that a judge order him to follow the timetable specified in the contract. Additionally, she states Martinez is not permitted to use travel as an excuse because therapy sessions are performed via Zoom.
The celebrity stated that the six combined sessions had a deadline of June 14 for completion.
Berry’s legal team, according to Radar, had argued that Martinez’s nonattendance from therapy was impeding the ‘development and best interests’ of their son. Berry said Martinez ‘continuously’ included Maceo in their disagreements, which made him ‘act out against her.’
Berry is «continually attempting to strong-arm [him] by forcing him into «submission» using her wealth, and the legal professionals at her disposal,» according to Martinez’s team in response.
In addition, Maceo’s attorney said that Berry filed the request after learning that Martinez would be traveling, despite the fact that Berry saw «no immediate harm» and that her request was ineligible for an emergency order.
